Welcome to MemoryLayers. In these Terms of Service, "MemoryLayers", "we", "us" and "our" mean the online retail business operated by Jan Martí Paredes, a sole trader established in Spain. Our customer contact email is contact@memorylayers.store. Our intended store domain is memorylayers.store. Our store is powered by Shopify.

These Terms govern your use of our website and your purchase of MemoryLayers handprint kits. Our Refund & Return Policy, Shipping Policy and Privacy Policy provide additional relevant information. Nothing in these Terms limits statutory consumer protections that cannot legally be excluded, including protections available to customers in the United Kingdom, Australia, Canada and the United States.

1. Eligibility and Acceptable Use

You may use our store for lawful personal and household purchases. You must provide accurate order, payment, contact and delivery information. If you create a customer account, you are responsible for protecting your sign-in information. Do not attempt to interfere with site security, conduct fraud, misuse customer information, introduce malware or unlawfully reproduce our materials.

2. Products

MemoryLayers currently sells family handprint kits. We aim to describe the product accurately. Minor differences in color or appearance may result from lighting, screens, materials or production variations, but this does not remove your rights if goods are defective, misdescribed or otherwise fail applicable consumer guarantees. Product images are illustrative of the product and its intended use.

3. Orders and Contract Formation

When you submit an order, you offer to buy the items at the prices shown during checkout. We may decline an order when reasonably necessary, for example because of unavailable stock, suspected fraud or an obvious pricing error, subject to applicable law. The sales contract is formed when we accept and confirm your order. If we cancel an order after collecting payment, we will refund the amount paid for the cancelled items and any related charges as required by law.

You may contact us to cancel or amend your order before dispatch. Our separate 30-day, no-questions-asked return policy applies after delivery, even if a kit has been opened or used. Mandatory cancellation or consumer rights are not limited by whether an order has been accepted or dispatched.

4. Prices, Taxes and Payment

Prices are shown in the currency made available to you by our store and Shopify checkout, including USD, CAD, AUD or GBP as appropriate. The full amount payable, applicable taxes and shipping fees is displayed before you confirm the purchase. We accept the payment methods displayed at checkout; payments are processed through Shopify and its payment partners.

Standard tracked shipping costs US$4.99 for orders below US$50 and is free for orders of US$50 or more, with equivalent checkout amounts shown in local currencies when available. Additional customs duties, import taxes and carrier clearance fees will not be charged to customers after checkout; where required, MemoryLayers will bear those charges or arrange resolution under our Shipping Policy. Please review the final checkout total carefully.

Discounts and prices may change for future orders, but changes do not retroactively alter a completed purchase except where applicable law permits a correction or cancellation.

5. Shipping and Delivery

We sell and deliver only to the United States, Canada, Australia and the United Kingdom. Orders are dispatched from China. Preparation generally takes one business day, followed by an estimated 7–15 days in transit. These times are estimates, not guarantees. Tracking is included with every shipment.

MemoryLayers remains responsible for goods in transit to the extent required by applicable consumer law. In general, the risk of loss or damage passes when the goods are delivered to you or a person you designate, subject to specific lawful exceptions where you independently appoint a carrier that we did not offer. If an order is lost, late, defective or delivered incorrectly, contact us to arrange a lawful remedy.

6. Returns, Refunds and Consumer Rights

You may request a voluntary return of a MemoryLayers kit within 30 days after receiving the order, for any reason. Opened and used kits qualify, including kits used to make handprints. Returns are free, with a prepaid shipping label. For eligible returns we refund the kit price and any original standard shipping charge paid; we do not impose a restocking fee or make deductions merely because the kit was used. UK consumers have separate statutory cancellation rights that generally permit cancellation within 14 days of receiving goods, and additional legal remedies for faulty goods. Australian customers retain all rights under Australian Consumer Law. Canadian and US customers retain applicable federal, provincial, territorial and state consumer rights. No contractual term overrides a non-excludable legal right.

7. Intellectual Property

Our original website text, branding, photographs, product designs and other materials are owned by or licensed to us or their respective rights holders and may be protected by intellectual property law. You may use the website for ordinary shopping and lawful personal use. You must not exploit protected materials commercially without permission, except where law permits.

If you submit a review or other voluntary feedback, you confirm that you have the right to share it and grant us a non-exclusive, worldwide, royalty-free licence to display and use that feedback in connection with the store, our services and their promotion. This permission does not transfer ownership of your feedback and is subject to your privacy and other statutory rights. Do not submit unlawful content or content that infringes others' rights.

8. Website and Third-Party Services

Our store uses Shopify and may use independent payment and shipping providers, as well as AliExpress/Choice fulfillment services for order delivery. We aim to keep the website available and secure, but temporary interruptions or errors can occur. We do not control independent third-party websites that may be linked from our site. When we use a supplier or service provider to fulfill your order, our contractual responsibilities as seller remain with MemoryLayers.

9. Privacy

Our Privacy Policy explains how personal data is handled for checkout, order processing, shipping, security, support and related uses. We do not currently send promotional marketing emails or SMS messages or run paid advertising campaigns. Shopify's cookie and privacy preferences may be available on the website. Where the law requires consent for optional cookies or processing, those uses must follow your choices.

10. Liability and Legal Guarantees

We do not promise that website access will be uninterrupted. Subject to mandatory law, we are not liable for losses caused solely by circumstances genuinely beyond our reasonable control. However, nothing in these Terms excludes responsibility for fraud, unlawful conduct, defective goods, consumer guarantees, or any losses for which exclusion is prohibited by law. In particular, nothing removes statutory rights to remedies, including repair, replacement, price reduction or refund where applicable.

11. Applicable Law and Dispute Resolution

MemoryLayers is operated from Spain, so Spanish law governs these Terms subject to mandatory protections and conflict-of-laws rules that apply to consumers in their country of residence. Nothing here requires a consumer to surrender a right to bring proceedings in a court or authority that has jurisdiction under mandatory applicable law. 12. Language, Changes and Contact

These Terms are published in English, the language used for our current storefront. We do not impose an English-language priority clause that overrides mandatory consumer rights or protections. We may update these Terms for future orders when business practices or legal requirements change; any applicable notification requirements will be respected. Changes do not retrospectively remove rights under completed contracts.
